He has a book called code and it is designed to let you think about legal codes on one hand or technical hands on the other He is arguing that the increasingly industry set technical standards that have the force of regulation and around content as well He wonders that maybe we should have a policy discussion about that out in the open before the codes get set down by the people writing the technological standards in different industries Who does this regulatory bodies legislative executive judicial state and local agencies Executive authority who sets the agenda for what is going to happen under a certain presidency FCC down at the bottom of the pic FCC looks at if they need to restrict increase vertical or horizontal integration If they want to change then they will propose new legislation to congress If it wasn t such a big re write he will go to the FCC and ask them to consider changing their rules But either a congressional law or the FCC internal processes could be challenged in the courts So all of these actors the executive power the presidency the legislative branch the judicial branch and the executive regulatory agencies that the presidency appoints members to and to some degree with the FCC a new president gets to appoint 3 of the 5 members The new political majority gets to have control of the FCC There will be a couple of members from the last administration So it won t be a completely unanimous process Both republicans and democrats and if they can t resolve the issues this ends up frequently in the courts Certain kinds of things we have a parallel thing in the states Like Texas has it s own telecommunications commission that does a lot of its work with the FCC You have federal and state versions of some of these things especially in big places like Texas
