candidate b DRAI rates the juvenile s propensity to commit another offense in the immediate future and or not show up for court c Three possible placements i ii iii Return home Enter a non secure residential facility or Remain in secure detention 12 What takes place at the detention hearing a Similar to first appearance in the adult system b Three activities at this point a The judge determines if there is sufficient probable cause that the juvenile committed a crime b The judge advises the juvenile about i The pending charges ii The privilege against self incrimination and iii The right to counsel c The judge must decide whether to detain or release the juvenile 13 What outcomes accompany the delinquency petition a The State Attorney s Office SAO must decide whether to handle the case informally or formally b Informal handling means a non judicial handling and the case is diverted outside the system c Some options include Teen Court A community service program Family counseling i ii iii iv Mental health treatment v vi d Completion of these alternatives can result in an expunction or expungement the juvenile s record is closed after satisfactory completion of the program and he she avoids an arrest history e If the SAO decides to handle the case formally then the SAO must submit a delinquency petition f A delinquency petition lists the charges and presents the probable cause for each charge A substantive intervention program and or Any other feasible option 14 What happens is arraignment a The arraignment must be held within 48 hours of the delinquency petition filing b The judge Reviews the charges Advises the juvenile of his or her rights Checks on the status of counsel for the juvenile and Asks the juvenile to enter a plea i ii iii iv c If the plea is not guilty the judge will schedule an adjudicatory hearing 15 What is the goal behind waiver a Waiver or transfer means the juvenile court relinquishes
