BMGT360 Case of Zimpfer 1 Was Mr Zimpfer a victim of illegal age discrimination according to the ADEA and case law Explain your position Cite relevant court cases to justify your position If you are undecided explain why It is to my belief that Mr Zimpfer is in fact a victim of age discrimination in the event of being denied for the position of employee relation s manager According to the case Mr Zimpfer had been a loyal employee at Palm Beach County for 16 hard working years this overtime enabled him to obtain valuable skills and experience that clearly puts him ahead of most of the candidates and more importantly classifies him as being more qualified than Mr J Brad Merriman This is demonstrated in the documentation provided by industrial psychologist Dr M Miller Josephs who evaluated the candidates resumes In order to conduct an objective analysis I evaluated Mr Zimpfer s case using the four sections to the Age Discrimination in Employment Act Firstly the subject is of age 52 which is in the approved age slot to be under protection Secondly Mr Zimpfer lost the role to an individual who is considerably younger aged 33 Thirdly not only was Mr Zimpfer looked over but also he was in fact not even interviewed for the role of Relations Manager a job to which he held greater amount of experience as well as qualification in comparison to the chosen candidate 1 What policies should the county adopt to reduce the possibility of age discrimination suits in the future In order to prevent such situations occurring in the future Palm Beach County can aim to ensure equal opportunities are available to all candidates who apply for the role and that their judgement to which the decision of who obtains the job is based wholly on their skills qualifications and experience rather than negative factors that could be deemed unethical It would also be advised that employees who do show commitment to the company for such a timescale as 16 years be shown enough respect and worth that they can be at least interviewed Hiring internally would not only help the firm wipe some of the misconceptions occurred from this event but will also boost employee moral and motivation
