October 30 2012Topic 11Look at the nature of sex crimesThey fall into 3 classes1. Nuisance crimes: nothing horrendous happens, but the activity is criminal. (Exhibitionism, wirism(peeping tom), rubbing up against somebody on a crowded area, adult molestation (inappropriate touching), blasphemy (but now is unconstitutional). a. Punishment can be prison time (Not too long). Exhibition and peeping tom punishment depends on your socio economic situation. Upper class can get therapy instead of jail (MONEY INVOLVED).2. Assault Crimes: some of these used to be probated for first offense but society has reduced its tolerance so it is not the case anymore. (FELONY)- Pedophilia (most prevalent)( even if there is no coercion involved, the very age of the victim is sufficient grounds for a assault) no penetration. - Enticing an individual to commit a sex crime is an assault.- Rape:- Aggravated Sodomy: One male on another. (Georgia says males cannot be raped by other males)3. Statist Crimes: Activity which under ordinary circumstances would not be criminal, but it is because of the statist of one or more of the participantsa. Statutory Rape: Having sex with an individual under the age of 16. Consent doesn’t matter. b. Prostitution: Voluntary sex between unmarried people. (No longer criminal behavior) but if the service is paid for, then it is criminal behavior. c. Juvenile Delinquency: Minors (under 18) can be convicted of delinquency if they engage in sex acts. Can be sealed so they can have fresh start after 18, but can be brought up later time.d. Incest: Consent here is not important, it is still a crime.- Progressive movement Early 20th century: For a male, it means that he did something (Stole a car, etc). They would treat is seperatley, and if convicted, they could be put in juvenile detention until 18. Girls can be delinquent if the girl did not obey her parents. All the parents had to say was that she was uncorrectable and they would send her to reform corrective school for girls. This school would teach girls how to live a descent domestic life (cooking cleaning etc). The idea that a femal could be out on her own making her own living was not reasonable. Aimed to prevent prostitution. The oldest profession: PROSTITUTION- Thrives wherever there are males willing to pay for it and women willing to sell their services. From the beginning of civilization.- In the ancient world, it was not illegal. - Owning a prostitution house was considered a business (legally)- Many prostitutes are slaves during ancient times. - In ancient Greece there was hierarchy for prostitutiono Lowest: AULTRIDES: street walkers, little to offer beyond sex service. ABORTION BIRTH CONTROL promoted. Ancient romans were anti abortion on the the common ground that they needed babies to turn into soldiers. (ban on abortion)- St. Augustine, started as an agnostic. Mother was st. veronica. He had in his youth a mistress whom he loved dearly, and by whom hehad a son. Wanted to marry her, but mother forbade it. So he abandoned her and the son who died at 18, and eventually became the bishop of Hippo and began to write about Christianity and sex. - He argued that prostitution was safety vale. Because it was drain off excess of lusty males and would actually prevent the degradation of their wives. Said that prostitution was necessary. - The view of women was essentially negative: they were all flesh, temptresses, would do anything to have sex and bear children.  Fall of roman empire, less dark, time of crusades.  Crusades introduced Europeans to various goods of Asian part of world. Trade increase, luxury items bought.  When you have increase trades, markets are set up, and where there are markets, there isprostitution.
