History transfers of Policy to Washington (1930s) The last recession is the 2nd worse we have had Unemployment was up in the 30 and 40 percentile Hoover didn’t do much and then FDR came in and said he would create jobs where they weren’t there. He created a number of new agencies so he could create jobs. The federal government grew 6th fold during his time. These notes represent a detailed interpretation of the professor’s lecture. They didn’t think he had a right to use the commerce clause for a lot of his stuff because the commerce clause only affected commerce directly traded across state lines. o So Roosevelt put another 9 justices on the court and they agreed with him and so his laws were passed. IV. Lyndon Baines Johnson Created Great Society Agenda He also created more than a hundred new programs including Medicaid He is giving out tons of money to states due to the Medicaid program They would give money to the states but with that money came guidelines that the states had to followV. Nationalization: The Solution to States’ Collective Dilemmas Collective Action dilemmas prompted states to ask Washington for helpo Coordination problemso Disaster reliefo Regulation of electrical transmissiono Reneging and Shirking Pollution-If something happens with pollution and if effects more than one state than the federal government will step in.o Cutthroat competition Wages – A minimum wage was set to ensure that states would notcontinue to lower wages, because each state would follow the other so they didn’t have to pay their employees as much or to ensure that other businesses would set up in there state so they wouldn’t have to pay their employees as much.  Environmental regulation – States would start to relax their environmental regulations to save money so the federal government has to set some laws to help the environmentVI. The Political Logic of Nationalization Difficult to lobby/persuade 50 separate states – If 20 states allow gays to marry and the other 30 don’t, it would be easier for all the gays in those 30 states to getthe federal government to pass one law allowing it in all 50 states than trying to pass a law individually in each state.  A more efficient method-a single federal law can change policy in all 50 states at onceo National government may be more receptiveo Also, opposite can be true Stem cell research Abortion onstate ballots Firearm safetyVII. Modern Federalism National government’s primacy in setting domestic policy is secure. (Affordable Care Act Upheld) National government has advantage in the courtso Garcia v. San Antonio Metropolitan Transit Authority (1985) Recently the Court has sought to limit federal authorityo The head Justice limited the federal government when it comes to thecommerce law. o Obamacare (ACA): Individual mandate to purchase health insurance unconstitutional under commerce clause.  Federal government can assert authority by using preemption legislation among other
