After public backlash, the rule was defeated. Imagine what this would have done to your cable bill!https://www.youtube.com/watch?v=fpbOEoRrHyUhttp://www.cnn.com/2014/11/11/politics/fcc-chairman-protesters/www.fcc.govFCC, Local Governments, and Prison Phone ChargesEver gotten a phone call from prison? These can be very costly (for either party). The FCC has tried to crack down on price gouging in this industry. http://time.com/6672/prison-phone-rates/http://knoxblogs.com/lady-justice-unmasked/2014/12/19/dirty-little-secret-behind-gouging-inmates-local-jails-state-prisons/Can the FDA regulate e-cigs?Proposed rules might do any or all of these:Ban internet salesBan certain flavorsImpose age limitsIs the FDA allowed to do this? In FDA v. Brown and Williamson Tobacco (2000), the Supreme Court said the FDA could not regulate cigarette adsCourt said this was beyond the scope of “delegated powers” (or “ultra vires” action)FDA had authority over “drugs and devices”…not ads!How might this apply if a court reviews e-cig rules? The Internal Revenue Service (IRS)Targeting ScandalIRS gives out 501 c4 status to non-profit groups that want to engage in political activity; but some groups said they were ‘targeted’ with delays in this process if their names indicated a conservative (or Tea Party) leaning:http://thedailyshow.cc.com/videos/cxccpp/barack-trek--into-darknessIThe Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF): “Fast And Furious” ScandalAnd here is a scandal relating to an ATF program that involved giving guns to Mexican drug dealers to then track where the guns went; as you might imagine, a lot went wrong here. Notice how this video explains how a president can use ‘executive privilege’ to attempt to evade a request from Congress for documents relating to bureaucratic activity:https://www.youtube.com/watch?v=Vgil5gKBwWEDepartment of Veterans’ Affairs (“The V.A.”) and its DelaysThe Veteran’s Administration was accused of delaying appointment availability for our nation’s veterans and also wasting money on lavish conferences. Problems were revealed by Office of Inspector General reports and media inquiries.http://thedailyshow.cc.com/videos/r9nm2k/v-a--men--delays-of-future-pasthttp://www.foxnews.com/politics/2012/08/24/conference-expense-list-details-millions-spent-by-va-in-latest-federal-waste/Drug Enforcement Admin. (DEA) raids NFL locker roomsOn Sunday November 16, 2014 the DEA sends agents to assess whether visiting team doctors were carrying pain killersIf pain killers are brought across state lines without appropriate documentation, there could be a violation of Controlled Substances ActKeep in mind: Agencies must respect 4th Amendment!!FEMA
