Discussion Question One Due Day 3 Thurs Miguel buys a truck in Texas then moves to Washington A year later he is driving his truck in Oklahoma and causes an accident by running into another car whose driver is from Florida In what states will the other driver be able to sue Miguel State the reasons for your answer Your carefully edited response should be a minimum of 350 words and posted to the thread titled Week One Discussion Question Two Thread in the Main forum The state the car was bought in Texas has no jurisdiction over either driver because they are not residents Though Miguel is a resident of Washington and the other driver is a resident in Florida neither was the state of the incident The driver should sue in Oklahoma because it was Oklahoma streets and traffic that the accident occurred in Oklahoma state law would apply to the accident If the driver sued in Florida then Florida state law and Oklahoma state law would apply and possibly conflict Second response This an interesting situation to consider because it happens quite frequently People are always traveling from state to state and make purchases else where In this situation if a law suit was to occur it would need to happen in Oklahoma I feel Texas has nothing to do with the current situation because that is simply where he bought the auto if there was a default with the auto such as it being a lemon then yes Texas may be the location of law suit Even though Miguel is from Washington and the other man is from Florida the accident was located in Oklahoma Since the incident occured in Oklahoma this means those involved are under the Oklahoma laws each state has many different laws they are allowed to decide on their own and they do not need to be the same as any other state within reason though many are similar Since the laws regarding traffic accidents in Florida and Washington are different than those in Oklahoma the Oklahoma laws must be applied because of the location of the accident I had a similar situation happen to my mother some time ago when she was hit by another person from Minnesota I am from Wisconsin That person did not have insurance which instantly makes things more complicated but we did not even consider taking this woman to court because we had insurance and your insurance company covered all our expenses and any compensation In turn I understood that our insurance company took this woman to court because she had no insurance and come to find out was not even driving her own auto but another s Adding that twist I was curious who would be to blame now but the owner of the auto had no fault in the situation only the woman driving I have not heard anything about the case since my mother s insurance simply left it with us that they would be handling this situation against the woman by filing a lawsuit against her I think it is important to realize that where ever any crime accident is committed you are under that locations laws be it another state or nation
