Running head Business Ethics 1 Business Ethics Calder v Jones BUS 415 Business Ethics Case 2 Business Ethics Case Calder v Jones In the case of Calder v Jones to say was it ethical for the two individual defendants to try and keep from being sued in California no it was not ethical it was self preservation The defendants knew what they had done was wrong and they did not want to be sued and knew their reporting techniques were at best seedy but ethically correct far from it This case for its time in 1984 even though the actual offense took place in 1979 was very groundbreaking while other cases of its type had come before Milliken v Meyer and Shaffer v Heitner but this case really focused on the relationship of the fair play and jurisdiction over non residents Due to Ms Jones type of career and her notoriety and the nature of the type of magazine that wrote the article on Ms Jones were all determining factors in this case Given the reporter was not a resident of California and only used sources of from California while residing in his home state of Florida made the case more interesting Adding to this case the magazine the reporter Calder wrote for the National inquirer which had a following in California and was the state of residence of Ms Jones gave credence to her case to sue in that state under the due process clause under the 14th Amendment This clause in the 14th Amendment is exactly what allowed California to prosecute residents of Florida and allow residents of California to sue residents of Florida The circulation of the paper in Florida and California helped Ms Jones case as well Ethically speaking to this case Calder claimed that he only vested California a few times once on business and once for a pleasure trip but did not operate business from that state so why should he be held accountable in that state The bigger question is why shouldn t be held accountable in California or Florida if misinformation about an individual is reported causing Business Ethics Case 3 loss of income or damaging career potential or any future earnings then that person or persons need to held accountable for their actions or words as it were in this particular case Business Ethics Case 4 References Find Law US Supreme Court Calder v Jones http caselaw lp findlaw com scripts getcase pl navby search court US case us 465 783 html retrieved 21st June 2010
