Access rules hotels:
hotels are a place people go for safety; fewer reasons to turn ppl away
Common law duty to receive:
-Inns have a duty to perceive prospective guests up to the limits of their physical capacity 24 hrs a day -restaurants and bars more selective
Excuses for turning down guests at common law:
-guest can't pay, guest would endanger others, hotel is full, hotel has a reason to believe room will be used for illegal purposes (drugs, prostitution), guest is extremely drunk and disorderly
Age excuse?
common law is silent on age issue
MO prom night law:
-authority to charge for room on credit card, damage deposit on credit card or cash, applies for under age of 18
Do hotels have to disclose overbooking to customers?:
yes, breach in contract, walk guest over to another facility
Pricing policies: -Anti trust laws:
-ensure the benefit of competitive prices and high quality goods and services, goal is to benefit the consumers -cannot agree with other hotels on prices
Rack rate laws:
-highest amount the hotel would charge for a given room. rarely charge it, have to post in room, crime to exceed rack rate
Price gouging:
-illegal in most states, can't raise price in dire need: natural disaster
Hotel entry:
-legitimate business reason (cleaning, maintenance, cry for help, emergency)
Police entry to hotel room:
-with a warrant from a judge or if guest agrees to let them in
Evictions: hotel/guest
-specified by state law, no right to initiate physical force, can self defend; evicted guest is a trespasser; assault/battery
Evictions: landlord or tenants
-rented apartment; court action necessary; specified in lease: not making rent, violating law; no force is allowed
Title 2 of the civil rights act of 1964; protected and targeted groups:
-protected: race, color, religion, and national origin -targeted groups: lodging facilities, dining facilities, places of entertainment, gas station -missing: age, gender, sexual orint.
remedies
-only equitable relief under this section, other claims may be joined w/ title 2 claim
private clubs can discriminate:
-exempt from civil rights laws, selectivity, discrete, criteria, member control, nonmember use, social purpose
Why are private clubs exempt
-right to freedom of association; -Mrs. Murphys: boarding house; exception to civil rights law bc facility has 5 rooms or less and manager lives on site
Service redlining:
-KC pizza hut manager refused to send a driver to high crime area

both lost cases
Class action:
procedural device that permits on or more plaintiffs to file and prosecute a lawsuit on behalf of a larger group of class; allows court to manage lawsuits that would be unmanageable
