BCOR 320 1nd Edition Lecture 6Current LectureFederalism: The national government power is limited to only the issue listed in article 1.Individual rights: The original constitution did not mention rights of citizens, sot the first 10 amendments spelled those out. Article 1: Congress with 12 houses, each state has 2 senators, representatives is relative to each state population. Commerce clause: Congress regulates commerce with other nations and between different states.Substantial effect rule: Congress may regulate any activity which has a substantial economic effect on interstate commerce. Dormant aspect rule: States are limited where their actions restrict free flow of interstate commerce. Article II: Defines the powers and responsibilities of the president and enforce the nation’s lawsAppointment: president nominates federal judges and heads of agencies. Legislation: president and advisors can propose bill to congress and the president can veto bill from congressForeign policy: president coordinates international efforts, negotiates treaties and is the commander in chief of military. Article III: creates the Supreme Court and permits congress to create lower federal courts. Adjudication: federal courts can hear civil and criminal cases with their jurisdictionJudicial review: Federal courts can declare a statue or government action unconstitutional.
