Chapter 1 Introduction to Law August 27th 2014 1 3 The Rule of Law Learning Objectives Rule of Law Understand what a rule of law system is Explore the U S rule of law system System of laws under which the people and the government are bound Legitimizes the law Establishes authority creates expectations for behavior and establishes redress for grievances and penalties for deviance English Bill of Rights of 1689 Contains the basis for many concepts contained in the U S Constitution o Rights of the people to limit the sovereign Attainment of peace relies on the establishment of hierarchical authority structure system o Code of Hammurabi Oldest record of seemingly complete rule of law o Magna Carta of 1215 Contains the basis for many legal principles recognized in the U S Constitution Includes due process and habeas corpus Composed of many different sources of law o Constitutional law statutory law rules and regulations promulgated by administrative agencies federal common law and treaties State Governments and local jurisdictions each have it s own rule of law systems Organizational structures of government are set out in rule of law systems Difference Between Power and Authority
