Poli 201 1st Edition Exam # 3 Study GuideThe ConstitutionArticle II Section I- The Congress may determine the time and date of choosing the Electors, and the day on which they shall give their votes, this day shall be the same throughout the United States- No person born outside the United States can become the President of the United States- During the time of the Constitution there was an exception to the qualificationof the President being born in the United States, because nobody had been born in the United States, they were all born in Great Britain- The President of the United States must be at least 35 years old, the day he/she takes Oath of Office, the President must also be a resident of the United States for at least 14 years- The Vice President becomes President, if the president is removed from office- Some causes of removal from office:o Deatho Guilty of Impeachment trialo Resignationo Inability to perform- If both the Vice President and President are removed from office Congress chooses who becomes President- If Vice President becomes President, the Vice President office remains vacant until the next election occurs- The President gets paid a salary and cannot turn down the salaryThese notes represent a detailed interpretation of the professor’s lecture. The President has the power to pardon any offense, except for a guilty choice inan impeachment- The President has power with the consent of the Senate to make treaties, with the a 2/3 of votes from those present- The President shall nominate with the consent of the Senate, shall appoint ambassadors by a simple majority ( 51 out of the 100 Senators)- Every federal judge is nominated by the President with the consent of the Senate- Congress can appoint officers- The President shall have the power to nominate vacancies that happen during arecess of the Senate, by granting commissions which shall expire at the end of their next session (When Senate comes back they can approve/disapprove him)Article II Section III- The President shall from time to time give the Congress information of the “Stateof the Union”, at least once a year- The President may on rare occasions convene both Houses or either House, called a “Special Session”- Both Houses go on recess at the same time- The President calls both Houses back of someone declares war on the United States- The president shall receive ambassadors and diplomats, makes sure laws are executed, and shall commission all officers of the United StatesArticle II Section IV- The President, Vice President and civil officers of the United States shall be removed from office on Impeachment for and conviction of:o Treasono Briberyo Other high crimes and misdemeanorsArticle III Section I- The Judicial power of the United States shall be vested in one Supreme Court and in such lower courts as Congress from time to time ordain and establish- There are no qualifications for a federal judge- The judges shall hold offices during good behavior and shall at stated times receive a salary- A federal judge job lasts for life- The federal judge has to be approved by the Senate, 2/3 of Senators present- A federal judges’ salary cannot be decreased- The judicial power has to look at laws and treaties to make sure they are constitutional- If a diplomat is suing/being sued, it automatically is a federal case, heard in theUnited States Supreme Court- Supreme Court usually acts as an appeals court and sometimes acts as a trial courto For example) When a diplomat sues a state- Court of Appeals is ONLY for appeals- Circuit Courts are ONLY trial courts- As an American citizen you have the right to a trial by a jury, for all crimes, the trial takes place in the state where the crime is committed, but if no one knowswhere the crime was committed, the Congress decides the place where the trial take pace- Treason:o Wage war against the United States (Assisting the enemy)o Giving aid and comfort to the enemy of the United States ( Sending money for weapons against the United States)- No one shall be convicted of treason without:o Confession or testimony of 2 witnesses- Congress has the power to declare the punishment of treason- Only the person guilty of treason is punished for treasonArticle IV Section I- Confederal government-limit on national government and state government has more power- Unitary government- has only a national government- Federal government- Federal government over powers the state government- Each state recognizes legal procedures of every other state ( If married in LA and move to Georgia, don’t have to get remarried)- Citizens of each state shall be entitled to all privileges and immunization of citizens in several states- A person charged of a crime in a state and flees that state, if caught in another state, the states that person committed the crime in can request him back to be tried, except of capital punishment (Extradition treaty)- If a slave escapes to a state where slavery is illegal, the slave is NOT free, the slave master can go into that state and get them back- In order to become a new state, it has to be approved by its original state legislature and by Congress- If property is owned by the United States, it is federal property, so the federal government makes the rules, nothing can change that- The United States shall guarantee to every state a republican- A republican government is the right to vote and create laws- The United States promises to protect each state and to put down domestic
