Nsg 423 1st EditionExam # 2 Study Guide Lectures: 5-8Lecture 1 (February 17)Is delegation permitted?It depends on the complexity of the task that is being delegated, the care needs of the client, as assessed by the registered professional nurse, upon the educational preparation, skills, and ability of the licensed practical nurse or unlicensed person to whom the task is to be delegated/assigned, and upon the availability and accessibility of essential resources including supervision, while the task is being performed.-Page 2What is the definition of delegation?Transferring to a competent individual the authority to perform a selected nursing task in a selected situation (NCSBN)- Page 3Does it list anything that cannot be delegated?Only those nursing activities commensurate with the educational preparation and demonstrated ability of the person who will perform the act may be delegate. - Page 10 Does it authorize the nurse to delegate based on certain circumstances?It depends on the availability and accessibility of essential resources including supervision, while task is being performed. Practice is limited to those activities addressed in the written policies and procedures of the employing agency, as long as those policies are not in conflict with West Virginia Law or rules -Page 12Lecture 2 (February 24)Define professional nursing.“The practice of "registered professional nursing" means the performance for compensation of any service requiring substantial specialized judgment and skill based on knowledge and application of principles of nursing derived from the biological, physical and social sciences, such as responsible supervision of a patient requiring skill in observation of symptoms and reactions and the accurate recording of the facts, or the supervision and teaching of other persons with respect to such principles of nursing, or in the administration of medications and treatments as prescribed by a licensed physician or a licensed dentist, or the application of such nursing procedures as involve understanding of cause and effect in order to safeguard life and health of a patient and others”- (30-7-1c)Describe the requirements for licensureTo obtain a license to practice registered professional nursing, an applicant for such license shall submit to the board written evidence, verified by oath, that he or she (a) is of good moral character; (b) has completed an approved four-year high school course of study or the equivalent thereof, as determined bythe appropriate educational agency; and (c) has completed an accredited program of registered professional nursing education and holds a diploma of a school accredited by the board.- (30-7-6) Describe the exemptions to the requirement for a nursing license.3.1.b.5G) The board may deny licensure or certification to any applicant who fails or refuses to submit thecriminal history records checks required by this subsection; filing of application - Page 296.4) An examination applicant may not repeat the licensure examination more than four times per year, nor more often than every forty five days- Page 31Lecture 3 (March 3)Describe for disciplinary action.Disciplining a licensee or applicant upon proof that he or she:(a) Is or was guilty of fraud or deceit in procuring or attempting to procure a license to practice registered professional nursing; or(b) Has been convicted of a felony; or(c) Is unfit or incompetent by reason of negligence, habits or other causes; or(d) Is habitually intemperate or is addicted to the use of habit-forming drugs; or(e) Is mentally incompetent; or(f) Is guilty of conduct derogatory to the morals or standing of the profession of registered nursing; or(g) Is practicing or attempting to practice registered professional nursing without a license or reregistration; or(h) Has wilfully or repeatedly violated any of the provisions of this article- (30-7-11)Describe the criteria for out-of-state licensure.The board may, upon application and proper identification determined by the board, issue a temporary permit to practice registered professional nursing by endorsement to an applicant who has been duly licensed as a registered professional nurse under the laws of another state, territory or foreign country. Such temporary permit authorizes the holder to practice registered professional nursing in this state while the temporary permit is effective. A temporary permit shall be effective for ninety days, unless the board revokes such permit prior to its expiration, and such permit may not be renewed. Any person applying for a temporary license under the provisions of this paragraph shall, with his or her application, pay to the board a nonrefundable fee of ten dollars.- (30-7-6)Describe the penalties for practicing without a license.It shall be a misdemeanor for any person, including any corporation or association, to:(a) Sell or fraudulently obtain or furnish any nursing diploma, license or record or aid or abet therein; or(b) Practice registered professional nursing under cover of any diploma, license or record illegally or fraudulently obtained or signed or issued or under fraudulent
