Miscellaneous Current Lecture:Behavior and Conduct Rules- (continued from last lecture)- Same sex displays of affection- if the city protected sexual orientation, this could be sexual orientation discrimination but federal law and MO state law does not protect this class- Policy prohibiting customers from speaking Spanish- Ex) bar prohibited customers from speaking Spanish amongst themselves, this is illegal- a perfect example of national origindiscrimination- Breast feeding- depends on the state, if there is a right for a person to engage in this activity These notes represent a detailed interpretation of the professor’s lecture. GradeBuddy is best used as a supplement to your own notes, not as a substitute.Miscellaneous- Korean restaurant refuses service to Caucasian couple- this is called reverse discrimination: racial minority is discriminating against racial majority; this is still considered illegal- Ladies tee times/club memberships- some women get worse tee times than men, golf courses are a place of public accommodation; federal law does not protect gender, so it would not violate federal law but most state laws do so it would be illegal in most states;private clubs can do what they want- they can discriminate if they want to- Poor customer service- Hispanics not served as quickly as white customers in a restaurant- is this legal?, the court said poor customer service is not sufficient enough to bring a civil rights complaint for discrimination here- No college students- ex: Apartments that do not rent to college students- is this legal? Fair housing law- there’s a list of protected classes under fair housing laws, college students are not one of them; there is nothing legally wrong with turning down college students as long as they are consistent with doing this.- Music selections- ex: night club owner varied his music choices to change the type of individuals coming into the club, so when the Hispanics came in he would play country music to try to get a different crowd in; court said there was no effort to eject anyone or refuse to admit anyone, so there was no basis for a civil rights case against him - Neo Nazi groups- ex: Columbia restaurants kicked out and refused to serve groups wearing Neo Nazi uniforms- nothing legally wrong with this, it seemed to have saved tension and violence- No children? No screaming children?- Can a restaurant say no children? Yes because ageis not a protected class under civil rights laws; Can you have a policy that says no screaming children? Yes, probably not a good idea but it is legal as long as you are consistent in carrying out the policy- Women’s only floors in Hotel?- Is this legal? Debatable. Federal law does not protect gender discrimination, only state and local laws, so federally it is legal, maybe not state/city wise. - Déjà Vu admissions policy- they scan your ID and if it comes back with criminal information that says you have been kicked out of there before, they do not let you in; this is not illegal as long as they are consistent with the
