Pols 1337 1st Edition Lecture 2 Current LectureParts of Constitution- Preamble- explains that it replaces problems from Articles of Confederation. Framers wanted to assure that the government’s sole purpose is to serve its citizens and will protect it. - Article 1- Establishes the first of three branches of the government: Legislature- Section 1- establishes name of Legislature to be The Congress, a bicameral body- Section 2- Defines House of Representatives and its requirements (25 yr. old age limit), establishes citizen ability to elect members every two years-members allotted based on population size and is proportionate for each state (more populous states more representatives)-Leader : Speaker of the House- Section 3- Defines Senate, requirements (30 yr. age limit)-senators serve 6 years-2 senators each state, regardless of population- Vice President is leader but does not vote unless a tie breaker is needed- Majority Leader has most power- Section 4-each state has authority to establish its own methids for electing members of Congress; requires that Congress must meet at least once per year- Section 5-Sets rules for Congressional meetings (req, number to start and adjourn, ability to expel members, journal proceeedings)- Section 6- Congress members will be paid, members cannot hold any other office while in Congress- Section 7- how bills become law1. Proposals start in House2. Must pass both houses of Congress3. States-declare war-raise money-Elastic Clause- allows Congress to pass any law necessary to carry out previously listed powers- Section 9-limits on Congress-suspension of habeas corpus-bills of attainder-prohibition of ex post facto laws- Section 10- prohibits states from making own money, declaring war, or other things prohibited for Congress in Section 9- Article 2- Establishes Executive Branch- Section 1- President and Vice President have set terms of 4 years- President to be elected by Electoral College (each state has one vote for every member of Congress)-35 yr. old minimum - must be natural born citizen of US-President paid by unwavering salary as long as he/she is in office- Section 2- President is Commander in Chief of armed forces and militia-has cabinet to aid him-ability to pardon criminals-deals with foreign affairs- -picks judges and other members of government with Senate approval- Section 3- Presidential Duty-give State of Union address -suggestions to Congress-head of state by receiving ambassadors-makes sure to execute laws- Section 4- Impeachment(removal of president)- Article 3 Establishes Judiciary Branch- Section 1-Supreme Court-highest court in US-sets terms for judges(Supreme and lower courts)-judges serve for life on “good behavior”-pay for judges- Section 2-Supreme Court first/original jurisdiction- other cases heard by SC are by appeal-trial by jury in criminal court- Section 3- defines crime of treason- Article 4- States- Section 1- all states will honor laws of other states- Section 2- all citizens of one state will be treated equally and fairly by other states- Section 3- admittance of new states and control of federal lands- Section 4- ensures representative democracy- guarantees federal government will protect the states against invasion and insurrection- Article 5- Constitutional Amendments- Article 6- concerns about United States-Constitution and all law treaties of US to be supreme law of country-US, under Constitution, would assume all debts and contracts entered into by US under Articles of Confederation-requires all officers of US to swear oath of allegiance to US and Constitution when taking office- Article 7- methods of Ratification of Constitution-9/13 pf original states had to accept Constitution in order to ratify it- First 10 Amendments are Bill of Rights( intended to protect individuals prom state of
